1. INTRODUCTION & ACCEPTANCE
Welcome to Wimbo Beats (“Wimbo Beats”, “we”, “us” or “our”).
Wimbo Beats is an AI-powered music creation service that enables users to turn ideas, feelings, memories, messages, stories, celebrations, gifts and dedications into personalised songs, primarily through WhatsApp and through any other channels we may make available.
These Terms of Service (“Terms”) govern your access to and use of Wimbo Beats, including our WhatsApp-based service, website, digital interfaces, song-generation features, audio files, lyrics, related content and any associated products or services (collectively, the “Service”).
By messaging Wimbo Beats, submitting a song request, creating an account where applicable, purchasing credits or services, downloading a generated song, or otherwise using the Service, you acknowledge that you have read and understood these Terms and agree to be bound by them.
If you do not agree to these Terms, you must not use the Service.
If you use the Service on behalf of a company, organisation or another legal entity, you represent that you have authority to bind that entity to these Terms.
These Terms should be read together with our Privacy Policy, Refund Policy and any additional terms presented when purchasing or using specific features.
2. DEFINITIONS
For the purposes of these Terms:
- “AI” means artificial intelligence, machine-learning models and related technologies used to generate or process content.
- “User” or “you” means any individual or entity accessing or using the Service.
- “User Content” means any text, lyrics, prompts, instructions, names, stories, messages, images, recordings, audio files or other materials you submit to Wimbo Beats.
- “Song” or “Output” means any song, lyrics, musical composition, vocal performance, instrumental, sound recording or other material generated wholly or partly through the Service.
- “Credits” means prepaid units, tokens or other entitlements used to access designated paid features.
- “Third-Party Services” means external services used to operate or support Wimbo Beats, including WhatsApp, AI model providers, hosting providers, payment processors and audio-processing services.
- “Commercial Use” means using a Song in connection with business, advertising, monetised content, products, services, public releases or other revenue-generating activities.
- “Personal Data” means information relating to an identified or identifiable individual, as defined under applicable data protection law.
3. ELIGIBILITY
NextSaaS services, platforms, and tools are provided under a commercial license agreement. Each subscription or license purchased includes access to updates and support for 365 days from the completion of the order.
License activation is necessary to receive updates and premium support. You are not permitted to resell, redistribute, or offer NextSaaS products or services, modified or unmodified, without our written consent.
3. Ownership and liability
All NextSaaS products, solutions, and materials remain the intellectual property of NextSaaS Technologies LLC. You may not claim ownership of our services, whether modified or unmodified.
Our products and services are provided “as is” without warranty of any kind, expressed or implied. NextSaaS is not liable for any losses or damages resulting from the use or inability to use its products.
User accounts and product licenses are non-transferable . For agencies and development partners: Please ensure your clients purchase their own licenses if they require direct support access.
4. Refund policy
We believe you’ll love NextSaaS! Still, if you're not satisfied, we offer a 14-day no-questions-asked refund policy. Simply contact our support team within 14 days of your original purchase, and we’ll issue a full refund. We might ask for feedback to help us improve, but you’re under no obligation to share.
5. Warranty
NextSaaS services are provided without any warranty, either expressed or implied. We do not guarantee full compatibility with all browsers, devices, third-party plugins, or external systems. Before purchasing, you may review demos or contact our support team to verify compatibility with your setup.
6. Account termination and suspension
NextSaaS reserves the right to suspend or terminate any user account without prior notice for reasons including but not limited to
- Abusive, defamatory, or malicious behavior towards NextSaaS staff or customers
- Spreading false information or misleading reviews
- Unauthorized resale, distribution, or promotion of competitor products
- Involvement in hacking, spamming, piracy, or illegal activities
- Security threats due to account compromise or unauthorized sharing
